Congress lacks authorization to "authorize" military action overseas.<br /><br />The Constitution grants Congress the power to declare war, or not. That's it.<br /><br />It was unconstitutional for Congress to "authorize" Bush to do as he will in Iraq or Afghanistan, and it was unconstitutional for Bush to accept.<br /><br />Bush should have demanded that Congress declare war, or state that he would do nothing.<br /><br />2. Even so, the Constitutional "living document" has so evolved (e.g. vague concepts like "police actions," or "authorizations" to do whatever is deemed necessary") that neither Bush's nor Obama's actions would be regarded as unconstitutional these days by the Supreme Court.<br /><br />Were the Constitution properly interpreted, both Bush's and Obama's wars are easily unconstitutional.<br /><br />Unfortunately, we never have a critical mass of people clamoring for strict construction.
